  1. What do you charge for a bankruptcy? 

Attorneys all have different fees and fee structures. Ask your attorney the total cost. Ask if there will be additional fees down the road or if the cost will increase with the time spent on your case. Find out if the court filing fees are included or if that will be an additional expense. 

  1. With your current caseload, what can I expect the timeline for filing my case to be? 

If you have an urgent matter such as a foreclosure, creditor lawsuit or wage garnishment, it is important to choose a bankruptcy attorney that can handle your case expeditiously. Find out what their current timeframes for filing are and see if your case can be processed quickly. 

  1. Do you practice other types of law besides bankruptcy? 

Find out if your prospective attorney practices various types of law and provides multiple services, or if they solely practice bankruptcy. This can mean the difference between finding an attorney that dabbles in bankruptcy vs. an attorney that is an expert in it. 

  1. Will I work with just you or do you have a staff that will work on my case? 

Don’t be afraid to ask your attorney if they are the ones that will be handling your case and about other staff members. An attorney with a team supporting him may be more efficient in getting cases processed and getting your questions answered quickly. 

  1. What if I have questions about my case during the process? Do I need to schedule an appointment? 

Finding an attorney that has an open-door policy for questions is very important. You need to know if you can call or email anytime, schedule an appointment and if you will be charged for the additional time spent with you in person or over the phone. 

  1. Do you have local offices or can things be done remotely? 

In our current times having an attorney that can provide services remotely and by email can be the most efficient way of doing things. However, for some, being able to sit down face to face is still important. Know your preference and see if it is offered by your potential attorney.

The attorney should be able to look at your big picture and know if filing is a good option for you. And in turn should also tell you if filing doesn’t seem like your best option.
