What Do I Need To Gather To File For Bankruptcy?

When filing for bankruptcy, you are expected to disclose any income, assets, debts and other financial activity during the period leading up to your case’s filing. In order to file, the first step is to gather the necessary paperwork and evidentiary material so that you may provide what the bankruptcy court will need to see in order to evaluate your case and approve the discharge of your debts.

Below is a basic list of the items needed in any potential case:
• Last 6 months of your paystubs or other documents showing income.
• Last 3 months of your bank statements for each account with your name on it.
• 2019 & 2020 State & Federal tax returns.
• Recent retirement account statement(s).
• Recent mortgage statement(s).
• Recent car loan statement(s).
• Statements or bills for all creditors.
• Any lawsuit paperwork.
• Recent whole life insurance statement for any policies in your name.
• Documents related to any business:
o Profit & Loss statements
o List of inventory/assets and account receivables
• Credit Counseling Certificate (This certificate can be earned online at
debtorcc.org) Cost – $19.95
• Copy or Photograph of ID and Social Security Card

Bear in mind, these documents are only necessary if they pertain to your situation. A retired single person will have to provide a lot less in paperwork to support the contents of their case filing as opposed to a married person who owns a business and an interest in real property. Married couples, even in cases where only one member of the household is filing, will usually have to provide this paperwork for any non-filing spouse as well.
